Terms and Conditions of Sale and Use (T&C)

These Terms and Conditions govern all transactions and the use of services on the El Morjane Shop website (elmorjaneshop.com), published by Europe HAA Limited.

1. Purpose and Acceptance

The El Morjane Shop website is an online store specializing in food products from the El Morjane brand and various Algerian brands. Placing an order on the website implies full and unreserved acceptance of these Terms.

2. Products and Pricing

  • Products: The essential characteristics of the products (ingredients, weight) are displayed on each product page. Photos are as accurate as possible but are not contractually binding.

  • Prices: Prices are listed in Euros (€) including VAT, excluding shipping costs. El Morjane Shop reserves the right to modify prices at any time, but products will be billed based on the rates in effect at the time the order is confirmed.

3. Ordering and Payment

  • The customer confirms their order after checking their cart and accepting these Terms. A confirmation email will be sent.

  • Payment is due immediately upon ordering. Payments are processed securely via PayPal or Stripe.

4. Delivery

Shipping conditions, fees, and delivery times are detailed on our dedicated "Delivery & Returns" page. Risk of loss passes to the buyer once the package is handed over to the carrier.

5. Right of Withdrawal & Food Product Exceptions

Under Article L.221-18 of the French Consumer Code, customers have 14 days to exercise their right of withdrawal. However, pursuant to Article L.221-28, this right does not apply to perishable food products or items opened after delivery for health and hygiene reasons. Returns of sealed, non-perishable goods are at the customer's expense.

6. Legal Warranties & Dispute Resolution

  • Our products are covered by the legal warranty of conformity and the warranty against hidden defects under French law.

  • Mediation: For unresolved complaints with our customer support (serviceclient@elmorjaneshop.com), European customers may use the European Commission’s Online Dispute Resolution (ODR) platform at: https://ec.europa.eu/consumers/odr.

  • Governing Law: These Terms are governed by French law.
